The Federal Court of the Federal District cleared the former dean of the University of Brasília (UnB), Timothy Martin Mulholland, of charges of administrative improbity. Mulholland was removed from office for purchasing luxury items for the functional apartment in which he lived. However, for federal judge Hamilton de Sá Dantas, from the st Court of the Judiciary Section of the DF, although questionable, the expenses were not used for the benefit of the former dean and Érico Paulo Weidle, dean of the administration of UnB, who was also cleared.
Dantas admitted the defendants' defense argument, which claimed that the assets were acquired for the “institutional development” of the university, intended to welcome members of the national and international academic community. The federal judge considered that the case must be handled at the administrative level, and not by the Judiciary, under penalty of violating the principle of separation of Powers.
When dismissing the Public Civil Action filed by the Austria Phone Numbers List Federal Public Ministry against the former rector and dean as unfounded, Dantas stated that, if he understood that there was administrative improbity in this case, the MPF would have to file actions against the administrators and members of the Legislative and Executive Branches. and Judiciary, and even the MPF itself, who, “notoriously, travel in luxurious cars and use facilities worthy of kings and queens”.
Timothy Martin Mulholland and Paulo Weidle were accused by the MPF of using, with misuse of purpose, resources from the Institutional Support Fund for the University of Brasília, originating from the Foundation for Scientific and Technological Enterprises (Finatec), intended for technological and scientific development and to research funding.
According to a lawsuit filed by the MPF, with the funds, a luxury car and several items of significant value were purchased, such as a -inch plasma TV, furniture and two trash cans with pedals, each valued at around R$, The MPF asked for the two to be ordered to return all amounts spent to the public coffers.
The former dean contested the action, claiming that he did not commit an act of administrative improbity, as he did not participate in the decision that gave him the functional property.
